California SB-577 (Acknowledgement)

OTHA.us and OTHA.Academy acknowledge the California Senate Bill SB-577 that affirms:

“the right of citizens to obtain Alternative and Complementary Health Care from practitioners other than licensed Physicians and Surgeons, or other licensed health professions.”

Background

In Paragraph 1 of SB 577 the Legislature made a finding that, based upon reports and studies, millions of Californians are receiving a substantial volume of health care services from complementary and alternative health care practitioners. Those studies further indicate that individuals utilizing complementary and alternative health care services cut across a wide variety of age, ethnic, socioeconomic, and other demographic categories.

Thus, the Legislature wanted to recognize Alternative and Complementary health care and provide a framework of guidelines and notices. Pursuant to this Act, Alternative and Complementary Health Care Practitioners must inform clients that they are not Physicians and Surgeons (or allied licensed practitioners) and that for Western medical diagnosis and treatment—including, but not limited to, prescription drugs, surgery, and the treatment of fractures, lacerations, and abrasions—clients must see an MD, Physician, or Surgeon.

The notice must also state the nature of the Alternative and Complementary health care practice that is being provided.

Nevada Guidelines

On June 9, 2015, Governor Brian Sandoval signed into law Nevada AB295, protecting Nevada citizens’ access to practitioners providing “wellness services.” The bill was introduced on March 13, 2015, signed into law on June 9, 2015, and went into effect July 1, 2015.

The bill came forth from a dedicated team working to protect access to wellness services including practices such as: anthroposophy, aromatherapy, traditional cultural healing practices, detoxification practices and therapies, energetic healing, folk practices, Gerson therapy, colostrum therapy, healing practices using food and dietary supplements, nutrients and the physical forces of heat/cold/water/light, herbology and herbalism, reflexology and Reiki, mind-body healing practices, non-diagnostic iridology, non-invasive instrumentalities, and holistic kinesiology.
